A situation known as Multiple Representation arises in Ontario when a single brokerage represents both the buyer and the seller in the same real estate transaction, either through the same salesperson (self-represented) or different salespeople within the same brokerage.
Under TRESA (effective December 2023), designated representation rules mean salespeople can still represent one party fully, even within the same brokerage.
Consumers must receive full disclosure of any multiple representation situation in writing and consent before proceeding.
